Most plane flights are safe. But when an accident, or plane crash does occur, it can be devastating and is often fatal.
Aviation law
Airplane operation and maintenance of aviation facilities are governed by federal and state aviation law, mostly federal. Aviation is considered part of "commerce", so that Congress can enact laws affecting airplanes.
The Federal Aviation Agency was established in 1958 and of the various Acts passed since then, the most recent was the Airline Deregulation Act in 1978. States can create their own laws only as long as they consistent with Federal laws.
Airplane accident investigations
Depending on the exact circumstances, plane crashes might be investigated by any of 7 federal agencies, as well as many state and local bodies. If you've been in any type of airplane accident, the investigation phase could be lengthy and complicated and your smartest move would be to contact an experienced airplane accident lawyer.
If your accident involved a military plane, it will be investigated by the Military Safety Mishap Board, who'll prepare a secret report, much of which the public will not be informed of. There could also be a Collateral report, depending on which service branch is involved, and this one is made public. But it doesn't contain any witness statements or manufacturer's analysis.
This all makes it complex to bring any lawsuit, as it's hard to dig up the most important information.
Military aircraft
Not all lawyers who handle airplane accidents will bring a suit against the government or military.
- In any civilian lawsuit against the government, attorney fees are capped at 25%
- Discovery can be extensive, complex, and time-consuming
If you're a member of the public and were injured by a military airplane, you can sue the federal government under the Federal Tort Claims Act. There's a two-year statute of limitations for this, as well as other requirements.
If you're part of the military and have been injured by a military plane, it's harder to sue the government, but you can sue the aircraft manufacturer and other private companies involved.
Potentially liable parties:
- Pilot
- Airplane design company
- Manufacturing company
- Plane component manufacturer
- Airplane owner
- Maintenance company
- Federal Air Traffic Controller
- Airport operator
